The Islamabad High Court (IHC) on Tuesday ordered reinvestigation of the Musharraf treason case and nullified the special court’s earlier decision which had directed the federal government to resubmit its complaint in the case after including the names of abettors in the charge sheet.
The decision was announced in response to three petitions filed separately by Shaukat Aziz, Zahid Hamid and Abdul Hameed Dogar against the order of the special court announced in November 2014, nominating them as co-accused in the high treason case.
The IHC bench comprising Justice Noorul Haq N. Qureshi and Justice Aamir Farooq had earlier reserved the verdict in the case on October 19.
Earlier, Additional Attorney General Afnan Karim Kundi had submitted before the IHC that the federal government was ready to examine the role of any abettor in the imposition of the 2007 emergency.
The trial in the treason case was stopped in December 2014 when the IHC admitted three identical petitions filed by Shaukat Aziz, Abdul Hameed Dogar and Zahid Hamid against the special court order.
Later on October 27 this year an order by the special court stated: “In view of the fact that the judgment of the Islamabad High Court is awaited, these proceedings are adjourned to November 27, 2015 at 9:30.”
The special court, hearing the treason case against former military ruler Gen (r) Pervez Musharraf, on October 15 2014 had demanded for a collective trial of all accomplices of the former president
The special court had used the word “selective investigation” which the government wanted to be expunged.
Musharraf had demanded that the civilian leadership and the military authorities that allegedly abetted in the imposition of the November 3, 2007 emergency should also be tried along with him.
According to the proclamation issued for the November 3 emergency, Musharraf imposed the emergency after consulting the then prime minister, the governors of all four provinces and the chairman of joint chiefs of staff committee, the chiefs of the armed forces, the vice-chief of army staff and the corps commanders of the Pakistan Army.
