Chief Justice of Pakistan (CJP) Iftikhar Chaudhry on Tuesday said money trail led to PPP leader Amin Fahim’s home.
Justice Chaudhry gave this remark while presiding over a three-member bench during the hearing of NICL case.
Commerce Secretary Munir Paracha, FIA counsel SM Zafar, Commerce Minister Amin Fahim’s lawyer and other senior officers appeared before the court.
The court was told that Fahim had appointed Ayaz Niazi. Four accused were out of the country and action was being initiated against them. Most of the accused, including Amin Fahim, who are present in Pakistan, have been released on bail. Rs 2.6 billion loss has been caused to national exchequer in NICL case and Rs 1.2 billion have been recovered. The amount transferred to Fahim’s account has now been transferred to respective accounts from where it was transferred.
The CJP said Ayaz Niazi was appointed under the directives of Fahim and transfer of money led to the minister’s home. What else was left, he inquired.
The court asked the commerce secretary to take action against the accused. “You have registered cases against them. Now provide the evidence against them too and if your evidences are proved false then action will be taken against you. When court starts hearing of any case then the government institutions become active and before it, all of them are lying in a state of slumber. Go and initiate proceedings against the accused persons. Register the cases against whom the cases have not been registered. FIA has done nothing against the accused sitting abroad except registration of cases against them. Under FIA rules if the accused sitting in Pakistan is not apprehended then how those sitting abroad will be arrested.”
Lahore Director Waqar Haider appeared before the court when the court sought report on the matter of Lahore land.
Haider told the court his case was lying before the bench, led by Justice Jawad S Khawaja, and it has not been fixed for hearing for the last two months.
Justice Chaudhry said, “What respect has been paid to the orders of the court that the person against whom SC has initiated contempt of court proceedings is enjoying directorship. [The] court has been made [a] laughing stock. What order is given is not implemented. What FIA wants? First of all we will see the matter of Waqar Haider and then we will see the other things. FIA should present detailed report on the entire case and its explanation with reference to Waqar Haider in the court. Whatever order is given to the government, activity starts contrary to the order. Opponent of [the] court becomes pious and virtuous person in the eyes of government.”
The court summoned the FIA director along with report on March 11 for keeping restored FIA Director Waqar Haider on his post despite issuance of contempt of court notice to the latter by the SC in NICL case.
The court directed Munir Paracha, counsel for FIA, that action should be initiated against the accused and report to the court in this regard.
