The Islamabad High Court (IHC) has suspended orders of a subordinate court and filed a case against SSP Yaseen Farooq and DSP Margalla. IHC Chief Justice Iqbal Hameed ur Rehman heard the case and legal counsel for federal police Niaz ullah Niazi prayed that the petitioner Rana Saeedullah had filed a case against Raheel Khan at Thana Kohsar over a dishonoured cheque. Deliberating details, the court was told that during investigations, it was revealed that Saeedullah and Raheel Khan had closed an estate deal for 93 kanals of land, worth Rs 300 million. However, Saeedullah had not transferred the land to Raheel, because the cheque for Rs 300 million given by Raheel Khan had been dishonoured at the bank.
The investigation officer had prepared a discharge report and recorded his statement, following which further enquiry was forwarded to the ASP secretariat, who after a detailed investigation, ordered the investigation officer to present a challan against Raheel Khan.
The investigation was forwarded by Yaseen to the Margalla ASP, who disagreed with the report, prompting Raheel Khan to request a new enquiry. The SSP had duly marked the memo for a new discharge report to the Margalla DSP on December 10, 2012, which was dispatched on December 14.
Rana Saeed ullah refused to participate in the enquiry and obtained a stay order from court, followed by an appeal to the subordinate court that Yaseen and Margalla DSP Abdul Rasheed Khan Niazi had received a heavy graft from Raheel Khan and should be summoned to the court.
The appeal was accepted by Additional Sessions Judge Khurram Ali Khan on January 3, which according to the petitioner police officers, was accepted due to oversight, as the case was already subjudice in the High Court.
