The Sindh High Court (SHC) has sought comments from the cantonment board Clifton on a petition alleging that high rise building ‘Majestic Plaza’ is being raised in the cantonment area in violation of its approved plan.
Headed by Justice Nadeem Akhter, the SHC bench was hearing the petition filed by Check and Watch Environmental Foundation, requesting the court to restrain Abdul Razzaq, builder of the project, from raising illegal construction in Delhi Colony, Clifton.
The petitioner submitted that it had received a complaint that the high rise building was being raised in the cantonment board Clifton without obtaining clearance and no-objection certificate from the authority concerned.
The NGO submitted that it had written an application to the chief executive officer of the cantonment board and its representatives also visited his office to get the copy of approved plan but the CEO did not bother to provide the same.
The petitioner added that as per rules the authority concerned can allow Ground+ one floor in the cantonment board. He added that the plaza was being constructed for commercial purpose in residential area which was the sheer violation of the law. Citing the cantonment board Clifton and builder Abdul Razzaq as respondents, the petitioner requested the court to restrain the builder from raising illegal construction in the residential area.
While directing the respondents to file their respective comments on 13th of June 2016, the bench also observed that no contraction should be raised in violation of the relevant building rules and regulations.
