Treason trial: SC issues notice to AGP in plea filed by ex-CJP Dogar

The Supreme Court on Tuesday issued notice to Attorney General of Pakistan (AGP) over petition filed by former Chief Justice Abdul Hameed Dogar against Islamabad High Court (IHC) order over inclusion of his name for investigation in the treason case filed against former president Pervez Musharraf.

The three-member bench of Justice Saqib Nisar, Justice Iqbal Hameedur Rehman and Justice Tariq Pervez heard the petition filed by former Chief Justice of Pakistan (CJP) Abdul Hameed Dogar challenging IHC refusal to hear his plea against the verdict of a Special Court in a high treason case.

A three-member Special Court of Justice Faisal Arab on November 27, 2015, had issued directives to Federal Investigation Agency (FIA) to submit a report after investigating the role of various “facilitators” in imposition of November 3, 2007 emergency in the country, including former prime minister Shaukat Aziz, Justice Abdul Hameed Dogar and the incumbent federal minister for climate change, Zahid Hamid.

During the course of proceedings, Iftikhar Gillani counsel for the former CJP said that his client did not play any role during the proclamation of emergency. Dogar had no role in the administrative affairs, he added.

He said that the Special Court’s order regarding inclusion of former CJP for investigation in treason case and terming him beneficiary of the emergency because he enjoyed the slot of CJP after proclamation of emergency was inappropriate.

Iftikhar Gillani pleaded the court to issue stay order against investigation till hearing of the case in the apex court. The bench rejected his plea and adjourned hearing of the case.
