The Islamabad High Court (IHC) on Wednesday re-issued notices to respondents in a plea challenging expected operation in Jammu and Kashmir co-operative housing society by Capital Development Authority (CDA).
The single-member bench of Justice Shoukat Aziz Siddiqui also maintained status-quo in the plea while hearing the four identical petitions claiming ownership of a number of plots in the society.
On 5 January, the court issued a notice to the respondents seeking a reply from them until 13 January but no reply was submitted, neither did they appear before the court.
However, the court re-issued notices to the respondents and adjourned the matter to the second week of the February.
Earlier, the petitioner’s counsel pleaded that his clients had purchased plots in the auction, and being bona fide purchasers; he constructed a building and sold some units to different people.
He said that the CDA issued a notice to demolish the property on 28 December 2015, which was illegal and requested the court to declare it null and void.
The petitioner has made CDA chairman, director enforcement CDA, and director housing CDA and Jammu and Kashmir co-operative housing society as respondents.
