Delays in ordered promotions vex IHC

The Islamabad High Court (IHC) has ordered the secretary establishment division to implement court’s orders in cases of promotion of civil servants from grade-21 to grade-22 and pay their dues to them besides seeking a report on the matter within 15 days.

The court issued these orders during the course of hearing of civil servants grade 21 to 22 promotion cases here Tuesday.

Promotion case of civil servants  including  Muhammad Iqbal Khan, Zafar Naqvi,  Salim Sheikh, Nadim Mansoor and others came up for hearing before single bench of IHC comprising Justice Shaukat Aziz Siddiqui .

Muhammad Shabbir Bhutta and Naeem Bokhari counsels for the petitioners appeared in the court and told that the petitions who are 23 in strength have performed their duty as civil servant grade-21 but government has not promoted them into grade-22.

They pleaded that the petitioners later approached Federal Service Tribunal (FST) for their right, which also gave decision in their favour.

They told the court that FST had ordered establishment division on April 22, 2013 to promote these officers in grade-22 besides making payment of their dues to them.

The petitioners approached IHC for implementation of these orders besides filing a contempt of court petition against the secretary establishment division. However, the court’s orders have not been implemented so far, they contended.

The counsels for petitioners further told the court that joint secretary had appeared before court on previous hearing and assured for implementation of court’s orders.

Following the completion of arguments, the court issued orders to secretary establishment division to promote the civil servants to grade-22 and make payment of their dues to them.

The court ruled if courts’ orders are not implemented by secretary establishment division then show cause notice can be issued against him and contempt of court‘s proceedings can be initiated against him.

The court adjourned the hearing of the case for two weeks.
