Govt can’t give decisions on whims: SC

  • SC dismisses Defence Ministry’s petition seeking restoration of its decision on sacking Maj Tahir

 

The Supreme Court (SC) has dismissed the petition filed by Defence Ministry seeking restoration of its decision on sacking Major Tahir.

A two-member SC bench headed by Justice Saqib Nisar and comprising Justice Ejaz Afzal Khan took up the case for hearing Monday. The court was told that service review board had retired Maj Tahir pre-maturely in 2000. However Defence Ministry dismissed Maj Tahir from service despite service board’s decision which is violation of law.

The court expressed displeasure over it and rejected the petition seeking revival of Defence Ministry decision.

Justice Mian Saqib Nisar remarked, “The government was not entitled to issue on its own orders for sacking employee from service following service review board decision. It cannot be done that government gives decision of its own choice whenever its wills so. When service review board had given decision as to why then the government gave decision in the presence of this decision.”
