Chief Justice Nasirul Mulk on Monday recused from the three-member bench which was formed to hear a petition filed by Pakistan Tehreek-e-Insaf (PTI) pertaining to recounting of votes on four National Assembly seats and implementation of recommendations relating to electoral reforms.
The development comes with Justice Mulk saying he was the acting chief election commissioner when the country’s supreme election body had submitted its response on the matter in the apex court.
The chief justice said it would not be fair on his part to continue hearing the case as he had represented the Election Commission of Pakistan (ECP) on the matter when a response was being filed in the apex court.
Justice Mulk ordered the formation of a new bench to hear PTI’s petition.
A new bench will now be formed and the petition will be heard on Nov 10.
