Reference filed against CJP, others under Article 209

Former law secretary Justice (r) Yasmin Abbasi on Wednesday said she had filed a reference with the president against the chief justice of Pakistan (CJP) and some former judges under Article 209 of the constitution.
Addressing a press conference, she said that 29 legal points had been raised against the sitting and former judges, seeking proceedings to be initiated against the CJP and his former colleagues, including Bhagwandas, Javed Iqbal, Shakirullah Jan, Nasirul Mulk, Ghulam Rabbani and Raja Fayyaz Ahmed who were accused of transgressing their authority by removing over 100 judges through a judgement.
“There is no record of the judgement of November 3, 2011, which was made a base of removing 100 judges of the higher courts. The promulgation of emergency on November 3 was according to the law and it had been done according to the law which was later given a constitutional cover by introducing article 270(AAA),” she alleged.
To a question about a letter she had written to the Swiss authorities for withdrawing the cases against former president Asif Zardari, she said the letter had been written to Swiss attorney rather than Swiss magistrate. She said she had written the letter in consultation with former law minister Farooq H Naek.
