Chief Justice Iftikhar Muhammad Chaudhry on Monday said every institution in the country was immersed in corruption and no one, including the subordinate judiciary, was a sacred cow.

“The muk muka culture is flourishing in the country. Premier institutions of the country are not immune. The court has its own limits. The government has not implemented recommendations made in several cases. Nine months have passed and no noticeable action has been taken despite the commission’s recommendations,” the CJP said.

He said NAB had not initiated any considerable action against the accused. “No one will be allowed to plunder public wealth,” he said.

Justice Jawwad S Khawaja said, “The government is not sincere in bringing back the hard earned money of the people which has been plundered and it is not even taking interest.”

A two-member bench presided over by Chief Justice Iftikhar Muhammad Chaudhry took up for hearing the case on loans written off during 1961 and 2009.

The court sought a detailed reply from the interior secretary on the commission’s report besides summoning Attorney General (AG) Munir A Malik on Wednesday for its assistance.

With reference to the commission’s report, Khwaja Haris said Rs 281 billion had gotten written off. “The commission has issued orders for further investigation into 225 cases. Over 50,000 people got their loans written off. Investigation has yet to be conducted in 232 cases. In several cases it has been said that names of defaulters be placed on the ECL. Rs 84 billion have been received. Investigation is underway in respect of Rs 9.5 billion. Not a single penny has been returned in 339 cases. The Ehtesab Ordinance needs to be amended.”

The CJP said, “In several cases the recovery of the amount is possible. I have seen no such case where the return of the loan money seems impossible. We can face difficulty such case where the company has lost its existence.”

Khwaja Haris told the court that all the recoveries could be made if NAB wanted.

Justice Khawaja said, “People have escaped after obtaining loans and no one has bothered to bring them back.”

Khwaja Haris said the amount could be brought back through plea bargain but no success could be achieved this way.

Later, further proceedings were adjourned until Wednesday.
