AG seeks SC’s guidance on honour killing, Qatal-e-Amd

Attorney General (AG) Munir A Malik has filed a reply in the Supreme Court (SC) pertaining to pardon in the name of Allah, compromise and Qisas, besides praying the court to provide guidance on 18 points.

The AG said in his reply, “The court has already given several decisions on pardon in the name of Almighty Allah, compromise and Qisas. If a new decision is needed any more, it will be limited to “Qatal-e- Amd” or it will apply to every case of Qisas. In case of confession of crime, repentance is pre-condition to compromise agreement. Does the criminal stand exonerated from crime in return for Qisas? What free will of party affected by deal on compromise implies?”

A three-member SC bench headed by Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry had given remarks on compromise in case of a murder that pardoning the killer in the case of deliberate murder was Fasad Fil Arz.

The court had sought guidance from Shahid Hamid and Mushtaq Gondal advocate besides directing the AG to file reply.

The AG has submitted reply through Additional Attorney General Tariq Khokhar and raised question related to 18 points, besides seeking court’s guidance on this count.

The guidance has been sought on the points concerning honour killing, Qatal-e-Amd, Qatal-e-Khata, decisions given in the past, release of hundreds of condemned prisoners and other points.
