Judges ensure authorities comply with constitution: CJ

Chief Justice of Pakistan Iftikhar Mohammad Chaudhry on Saturday said courts had the power to revoke any law if it was found in violation of or in conflict with the fundamental law. During a law conference in Sukkur, the chief justice said it was the court’s responsibility to see that the government and other institutions followed the constitution. Moreover, he said the constitution gave protection to the fundamental rights and the court was working for peace and stability in the society with the help of bar and bench. He said the judiciary as the third pillar of the state in a constitutional and democratic dispensation, operating under the system of “separation of powers”, was required to define and interpret the law and the constitution.
“Besides the interpretation of law, the judiciary is also required to dispense justice by resolving conflicts and deciding disputes. The primary objective before judiciary is to restore and maintain peace, security and tranquility in society. It is to encourage trade, business and commercial activities and attract foreign/local investment. This is the surest way to advance and develop, and to achieve technological and industrial/commercial progress,” the CJ said.
He said the courts undoubtedly adhered to law and constitution, thereby encouraging good governance and clean administration.
“In constitutional democracies like Pakistan, the courts play an important role to ensure that the state institutions and authorities fully comply with the constitution,” Justice Chaudhry said.
Emphasizing on cordial relations between the bench and bar, the CJ said the bench and the bar were two pillars on which the edifice of justice rested. Both the judges and the lawyers were involved in the process of dispensation of justice and in building a credible and efficient judicial system, which enjoyed public trust, confidence and respect, the CJ added. He also expressed his concern on the falling standard of education in the country.

  1. supreme court and chief justice are totally biased against the government.it is very obvious that no justice is expected from them.

    • CJ of Pakistan is right in being very assertive. National Reconciliation Ordinance (NRO) was fashioned on the lines of the Truth & Reconciliation Commission of South Africa (SA); those befitted from it in SA first accepted their wrong doing following which they were pardoned. These individuals never progressed to contest elections and held public offices.

      NRO is one of many tragedies, almost all great, that Pakistan faced. This materialised an understanding between two criminal mind sets, one of outstanding negative calibre of Benazir and her cronies and the second of Pervaize Musharraf, with the sole objective of bringing the former to power and keeping the later in the office.

      Benazir's assassination paved the way for convicted criminals like Zardari and his cronies to power.

      This criminal mind set has led to the ruining of major corporations as a result of mega sandals going to the highest level also involving the office of the PM of Pakistan.
      Supreme Court of Pakistan must continue to forge ahead forcefully and not deterred by any adverse comments.

  4. CJ must resign. He has become controversial. His impartiality has already been in doubt. His actions smell of power politics.

  5. CJ has been conducting like a head of a political party, and he is clearly biased in his statements which hv been political all along. He falls short of decorum of a neutral and unbiased judge. Had he been in a Western country, he wud have been forced to resign because of his lust for publicity, and political statements.

    • Politicians are corrupt no doubt in it but only politicians are corrupt in this country ??? No my dear from judges to generals and bureaucracy to journalists no one is innocent . When we say that CJ should kick out these politicians . This may b acceptable for lot of people who thinks this CJ is honest . But in future PM could b IK (just example) and CJ could be like Mr. Dogar then what will happen to those persons who are enjoying today if same practice will be repeated. This looks great only in books that justice must be done Though The Heavens fall …. Every pillar of a state must work in its boundries …

      • This is a very pathatic situtaion as stated by you. How about just undo Pakistan i.e. there should be no country called Pakistan if there is no hope now or in future. Just decalared it a failed state and merge pieces of this country to other neghbouring country. Looks like it is headed in that direction. Maybe this it should happen sooner than later. Ordinary people would not be worse off than they are today.

  6. u cud not put even small coma to presidents' political,partisan role in president house,at state expense.how can talk of upholding constitution.you have let a law absconder control national politics from london on tv speeches,his party target killings of thousands,bathakhori of trillions was condoned in ur karachi judgement.how can claim upholding constitution till u convict the two .

  7. Can a convicted and criminal is eligible to hold top executive position in pakistan? is this not aganist the fundamental law.

  8. Iftikhar Double PCO must stop political canvassing. His only object is to gain more and more power and make more and more money. Even if he had justice as his last priority, it would have been great. The tragedy is that justice is not in the list of his priorities.
