SC likely to form joint investigation team to probe into Benazir murder case

A three-member Supreme Court bench, which will resume hearing today (Monday) in a plea seeking orders for registration of a second first information report (FIR) against former president Gen (r) Pervez Musharraf and 12 others in the Benazir Bhutto assassination case, is likely to form a joint investigation team (JIT) consisting of top officials from all four provinces to investigate into the matter.
The bench comprises Chief Justice Iftikhar Muhammad Chaudhry, Justice Khilji Arif Hussain and Justice Tariq Parvez. Attorney General Maulvi Anwarul Haq will appear on notice. On the last hearing, the court had directed the attorney general to seek instructions from the government for the registration of a second FIR into the murder case and inform the court.
Expressing his concern over the Federal Investigation Agency’s (FIA) uncooperative attitude with the Supreme Court, the chief justice had observed that there was no independent investigation agency in the country, therefore, the court might form a joint investigation team consisting of top officials from all four provinces to investigate the matter. The court had also directed the respondents, including Pervez Musharraf, Interior Minister Rehman Malik, former law minister Babar Awan, former Punjab chief minister Pervez Elahi and others to file a detailed reply into the matter.
The court had also summoned the record of the case along with copies of order-sheets and the progress so far made before the Anti-Terrorism Court, Rawalpindi, where the case is under adjudication.
“It is an extraordinary case involving assassination of a former prime minister and the country’s president also wishes to know about it, so take it seriously,” the chief justice had told the attorney general.

SC takes up plea for fresh FIR of BB’s murder today

The proceeding of a petition seeking the registration of a complaint against former president Pervez Musharraf, Pervez Elahi, Rehman Malik, Babar Awan and other former top team members of the Musharraf regime for the murder of Benazir Bhutto will start today (Monday) in the Supreme Court of Pakistan. The petition was filed by Chaudhry Aslam, protocol officer of Benazir. Aslam prayed the court to order the police to register a first information report (FIR) against his complaint against Musharraf and his former close associates in the government. He declared Musharraf, Brig (r) Aijaz Shah, Pervez Elahi, Genral (r) Hamid Nawaz, Kamal Shah, Brig (r) Javed Iqbal Cheema, Irfan Elahi, Saud Aziz, Yasin farooq, Rehman Malik, Babar Awan and others responsible for the murder of Benazir Bhutto or conspirators in the murder. He first gave an application to the Rawalpindi chief police officer in July 2009 for filing the complaint but he did not get a response. He then filed an application in Sessions Court Rawalpindi, but his plea was not allowed. Another of his filed application with the Lahore High Court was also disposed of and he finally moved the Supreme Court through Rasheed Rizvi.
