Application seeks to revoke NAB Ordinance 1999

An application was filed in the Lahore High Court on Wednesday seeking direction to set aside NAB ordinance 1999 because it was promulgated by an ‘unconstitutional and unlawful’ president Pervez Musharraf.
The application was filed by Muhammad Altaf into his already pending writ petition against NAB wherein LHC had suspended investigation proceedings against him. He said NAB had become redundant because its formation was not complete. He said office of chairman was vacant since long while appointment of NAB Punjab DG had also been challenged in LHC.
He pointed out that Musharraf had promulgated this law and former president Rafiq Tarar had filed a constitutional petition in LHC that the parliament had not validated Musharraf’s acts. He requested court to declare the said ordinance ultra vires of the constitution and nullify all orders passed by all accountability courts throughout Pakistan in absence of NAB chairman. He prayed that NAB head office be sealed and all accountability court be abolished besides requiring parliament to enact a new law on accountability.
A division bench headed by Chief Justice Ijaz Ahmad Chaudhry will take up the case today. LHC requested to restrain NAB DG from functioning: An application has been moved in the Lahore High Court (LHC) for restraining Rana Zahid Mahmood as National Accountability Bureau (NAB) Director General (DG) from performing his functions because his contract of employment has expired and he was working unlawfully. Shah Faisal Qureshi, the petitioner, through his counsel Muhammad Azhar Siddique, challenged appointment of Zahid as NAB DG. A bench will hear the application on April 28.
