LAHORE – Lahore High Court Justice Sheikh Azmat Saeed on Wednesday issued pre-admission notices to the Punjab government and other respondents on a petition challenging the establishment of Liberty Park and Ride Shopping Plaza. Judge directed the respondents to file the replies till February 17.
The petition is moved by seven petitioners including Muhammad Azhar Sidduque, chairman of a law firm, Mohammad Saleem Hafeez, Mian Mohammad Haroon of Hotel MelRose Inn, Arshad Kareem Qureshi of Toy Land, M Zakariya Basheer Malik, Arif Mehmood of Liberty Gift Center, Syed Dilawar Shah of Alnafay Shopping Mall, located at commercial zone, Liberty Market.
The petition is filed against government of Pakistan through its secretary law, government of Punjab through its secretary law and parliamentary affairs, housing, urban development and public health engineering department, Lahore Development Authority (LDA) through its chairman, Parks & Horticultural Authority (PHA) through its chairman, the director, estate management, LDA, director, TEPA and the provincial environmental protection agency.
Petitioners counsel Muhammad Azhar Siddique submitted that the land was an open space owned by the PHA which illegal transferred to LDA for construction of this plaza. He said in this plaza the shops are also constructed for running business which was badly affecting the petitioners.
He requested to declare that this open space is still in the ownership and control of PHA and that all subsequent transactions or transfers of it by any authority are without any legal jurisdiction and have to be treated as nullities in law.
