SC rejects petition seeking shifting of child to Karachi in custody case

ISLAMABAD: The Supreme Court of Pakistan (SC) has rejected the petition of a father pertaining to his child’s custody and remarked that the mother cannot be deprived of her child for the convenience of a father who lives abroad.

A three-member bench of SC headed by Justice Umar Ata Bandial heard the case on Friday.

Justice Ijazul Ahsan inquired why the petitioner was insisting on shifting the child to Karachi upon which the counsel to the child’s father informed the court that the minor’s father was currently residing in Kuwait. Since flights from Kuwait to Karachi were more frequent as compared to Islamabad, the father wants that the child moves to Karachi so that meetings are more convenient.

The court while ordering to temporarily keep the child under mother’s custody for one year permitted the father to meet his child on a weekly basis.

The court further stated that in case of permanent return of the petitioner to Pakistan, he can go to the court for the child’s custody after one year, however, the mother would not be deprived of her child until then.
