Islamabad High Court (IHC) sought explanation from Prime Minister Shahid Khaqan Abbasi on important constitutional issue of denying the mercy appeal of death plenty of a criminal.
Citizens of Gilgit-Baltistan (GB) Muhammad Ishaq and Khan Muhamad filed a writ petition in IHC, in which the Government of Pakistan, PS to Prime Minister Fawad Hassan, Ministry of Kashmir Affairs, GB Council, the Government of GB were made party.
After hearing the arguments of Rai Nawaz Kharal (Petitioner’s counsel), the court issued notices to the parties. Learned counsel said that Muhammad Ishaq was given death sentence by GB court, while the appeal court converted death sentence into life imprisonment.
Ishaq appealed for mercy to PM which was rejected, PM as a chairman of GB council can’t pass any order against the citizen of GB.
Court also sought explanation that whether PM can accept or reject such request from GB citizens, as GB is an independent territory.
