ISLAMABAD: Justice Amir Farooq of the Islamabad High Court (IHC) on Thursday forwarded Tehreek-e-Insaf (PTI) Chairman Imran Khan’s petition challenging the issuance of his non-bailable arrest warrants by the Election Commission of Pakistan (ECP) to IHC Chief Justice Anwar Khan Kasi for shifting the case to a larger bench which will hear the case on October 23.
Imran’s counsel Babar Awan appeared before the court.
As the hearing went underway, Awan pointed out that another petition of Imran, similar in nature to the filed petition is pending to be heard by the larger bench of the IHC. Therefore, Justice Amir Farooq observed that it would be better to forward this case to the larger bench as well.
Arguing that ECP has no authority to issue non-bailable arrest warrants, Imran’s counsel Babar Awan termed the warrants issued by the ECP on October 12, unconstitutional and illegal.
Not only has the issuance of non-bailable arrest warrants by ECP caused mental pain to Imran Khan but even the ECP is being criticised over it by Imran’s political opponents, Babar claimed.
Babar pleaded with the court to nullify the issuance of Imran’s non-bailable arrest warrant.
The ECP had ordered that Imran should be arrested and produced before it on October 26.
The larger bench of the IHC will initially hear the petition on October 23.
