SC to decide HEC fate

ISLAMABAD – The fate of higher education in the country will now be decided by the Supreme Court, as a petition filed against the government’s decision to devolve the Higher Education Commission (HEC) has been fixed for hearing tomorrow (Monday).
Chief Justice Iftikhar Muhammad Chaudhry on Saturday passed the order on a constitutional petition filed by Professor GA Miana.The federation has been named respondent in the petition through the Law Ministry. “Put up this case in the court on April 11, 2011, before Bench No 1,” the chief justice directed the SC Registrar’s Office.
The petitioner has prayed that the devolution of functions and authorities of HEC to the provinces through a government notification March 31, 2011, or any other notification or order or directions or command or by any means be declared unlawful and unconstitutional, void ab-initio.
The chief justice has clubbed with the petition another application seeking suo moto action to save the higher education sector in the country filed by Professor Attaur Rehman.
