Another look at 21st amendment, military courts, may be?

Making the federation and provinces as respondents, the Lahore High Court (LHC) Bar has filed a review petition in Supreme Court (SC) against the apex court’s decision in the case of 21st Constitutional Amendment and establishment of military courts.

The petition said that military courts and 21st amendment constitute “sheer violation of basic structure of the constitution and fundamental rights”. Eliminating terrorists, arresting and interrogating them and ensuring award of punishment to them is responsibility of the executive, it said, adding that if it is done so, then it is failure of administration rather than judiciary.

It has been further lamented in the petition that the military courts have been declared lawful. Through establishment of military courts, fundamental rights have been restricted and right to fair trial has also not been given, therefore court should review its decision, it contended.
