PHC reserves judgement on KP local govt re-poll petitions

The Peshawar High Court reserved its judgement on 20 petitions filed against local government re-polls in 365 polling stations in KP on Wednesday.

The two-member bench of Justice Waqar Ahmed Seth and Justice Qaiser Rashid Khan are likely to announce to judgement on Friday, according to sources.

The bench had adjourned the hearing of petitions filed by Pakistan Tehreek e Insaf MPA Zahid Durrani and two others till Thursday (today).

Justice Waqar remarked that the Election Commission of Pakistan had the authority to conduct elections and decide schedules.

Justice Qaiser questioned denying women sufferage, claiming that there was no law limited women from exercising fundamental rights to vote on Election days.

Counsel for petitioner Nawaz Ali Khan, Amjid Ali told the court his client was declared as the returned candidate and the RO had announced Nawaz received 1,651 votes while the runner-up received 1,372 votes on May 30.

He said subsequently the DRO announced re-polls at a women’s polling station where only nine votes were cast on Election Day. “The DRO has no authority to order re-polls in any polling station,” he contended.
