The Sindh High Court (SHC) on Monday issued notice to prosecutor general Sindh and other respondents to file their comments on an application seeking transfer of murder case of gang-rape survivor, Kainat Soomro’s brother from the criminal court of Dadu to Karachi’s court.
A single bench comprising Chief Justice Maqbool Baqar had taken up a criminal transfer application filed by Kainat’s mother, Zakia Soomro, who impleaded the prosecutor general and accused persons in murder case of her son as respondents.
The applicant’s counsel Faisal Siddiqui submitted that the judicial magistrate Mehar while accepting the police report in A-class had acquitted all accused persons nominated in the murder case of Niaz Nabi aka Sabir Hussain Soomro. He added when Ms Zakia approached the SHC against decision, it set aside the ruling of judicial magistrate and directed him to pass speaking order within 15 days after hearing parties.
He stated that since the Soomro family had moved to Karachi due to serious threats from accused persons and advocates pursuing its cases on pro-bono basis were also residing in Karachi, therefore, this case be transferred to Karachi. He requested the court to order transfer of the murder case from Mehar district court to any court in Karachi.
According to complainant Ms Zakia, her son Niaz was abducted by four accused including Ali Hussain, Asad, Manthar Ali and others with help of local police, who tried to coerce her into withdrawing her daughter’s rape case. Upon refusal, she said, the accused persons killed him and dumped his body in Balochistan.
