When it comes to NAB, ‘might is right’

The Islamabad High Court (IHC) has reserved judgment on bail after arrest plea in respect of former Pakistan Electric Power Company (PEPCO) Managing Director (MD) Fazal Ahmad Khan in rental power case.

IHC Chief Justice Justice Muhammad Anwar Khan Kansi took up the case for hearing Monday.

Wasim Sajjad and Idrees Ashraf, counsels for the petitioner, and National Accountability Bureau (NAB) senior prosecutor Sardar Muzaffar Ahmad Khan appeared in the court.

The counsel for petitioner argued that PEPCO MD Fazal had been illegally arrested in rental power case.

No evidence of corruption is available against the petitioner nor has any clear evidence of corruption been found against him in the NAB reference and enquiry, said the counsel

Sajjad told the court that an accountability court had received the amount from the company side. Five other people facing charges have not been included in the inquiry, he said.

The NAB prosecutor told the court that evidence are available on involvement of the petitioner in causing loss of over Rs 139 million to the national exchequer in rental power case. NAB has filed reference against the petitioner and further enquiry is underway. “The petitioner inflicted loss to national kitty and gave benefit to the contractors in rental power,” said the NAB prosecutor.

The judge remarked that Nab should provide solid evidence against the petitioner in writing to the court, instead of levelling mere allegations.

“Might is right law is in place in NAB. They arrest and release whomsoever they will,” said the judge.
