No one can dictate the court: Justice Jawwad Khawaja

Justice Jawwad S Khawaja on Tuesday said no one could dictate the court and the court had to render decision per law and constitution.

He gave these remarks during the course of hearing of LPG quota case by a three-member bench of the Supreme Court (SC) on Tuesday.

Chief Justice of Pakistan (CJP) Iftikhar Muhammad Chaudhry presided over the bench.

Justice Jawwad further remarked, “If 27 companies are not trustworthy then why has the government not taken action against them so far?”

Addressing Khawaja Asif, Justice Jawwad remarked, “You had come to SC in 2011 under compulsion being in opposition. Now you are avoiding to take action under some compulsion while being in the government.”

The petitioner, Khawaja Asif, requested that no more companies be allowed to become party in the case.

The court while expressing displeasure over it remarked the court would do every job to its satisfaction. The court allowed seven more companies to become party in the case.

The court rejected the plea of Khawaja Asif of not making him party in the case.

The CJP, while expressing annoyance, remarked “If you award punishment of a single day to anyone, it will become necessary for the court to hear him.”

He further remarked why the petitioner was opposing Pioneer and Taiz companies.

Asif said the Ministry of Petroleum had constituted a committee for investigation and it had probed into irregularities. “The committee maintained that same parties were on both sides of the case,” he added.

Irfan Qadir, counsel for Pioneer and other companies, said, “Khawaja Asif used wrong language in respect of the companies.”

Asif said that the OGDCL had obtained a stay order with reference to LGP Quota.

Justice Jawwad remarked, “The court will not initiate proceedings if a stay order is there.”

Seeking attested copies of the joint venture, the court adjourned the hearing of the case until October 8.
