Body should have considered lawyers’ objections: Asma

Former Supreme Court Bar Association president Asma Jahangir on Saturday said the Parliamentary Committee should have considered the objections raised by lawyers before appointing three new judges for the Balochistan High Court.
In a statement, she said further the judges nominated for the BHC by the Judicial Commission has been strongly opposed by the Balochistan High Court Bar, the Supreme Court Bar (Balochistan), the Pakistan Bar Council (Baluchistan).
A majority of the lawyers passed a resolution against the nomination in the meeting conducted by the Balochistan High Court Bar Association on August 2. The Lahore High Court Bar also supported the resolution.
Asma said that the Parliamentary Committee should not nominate judges who are not up to the caliber/status of lawyers community.
She also said the procedure adopted by the Supreme Judicial Council post a judgement of the Supreme Court has reduced the role of the Parliamentary Committee into a rubber stamp. Non-judicial members of the Supreme Judicial Council are merely tolerated.
She said further judges select their successors making independence of the judiciary a total farce. Woefully, the legal community did not make sacrifices for a judiciary that is not selected on merit but on personal likes and dislikes. This trend has also given rise to a section of lawyers who play to the tune of the judiciary. This has also damaged the independence of bar associations.
The Parliamentary Committee should play a constructive and proactive role in obstructing appointments made by the SJC which lack merit. Democracy will not take root if the judiciary lacks capacity and respect of the legal fraternity.
