The Lahore High Court (LHC) issued a show-cause notice for contempt of court to Punjab Beverages Company Director Finance Fayyaz Hussain for impersonating a Federal Board of Revenue (FBR) representative in a case.
The court ordered that charges be framed against him on the next hearing of the case on August 6.
The court also ordered the Interior Ministry to place Hussain’s name on the Exit Control List (ECL) till further orders.
Justice Syed Mansoor Ali Shah passed the orders while dismissing an application by Hussain for recalling the July 30 order against him and for the acceptance of an unconditional apology.
Hussain along with his counsel appeared before the court and submitted an application that the court on July 30, held him guilty of impersonating FBR Chief Tax Ashfaq Ahmed Tunio in the presence of the FBR counsel in a Gourmet Foods Company case.
The appellant said he was called to the rostrum by FBR counsel Muhammad Ilyas Khan during the hearing of the case on July 19 and the slip of attendance submitted by him, identifying himself as FBR chief, was because he thought he was being asked by the court as to who had issued the orders.
However, the FBR counsel said the applicant identified himself to be Tunio and it was for this reason he was called to the rostrum.
He further said that during the course of hearing he advised him to oppose the suspension of the impugned notification and also made a statement that no recovery proceedings would be initiated against the petitioners.
The court observed that the applicant had deceived the court by identifying himself as Tunio and the fact was corroborated by another statement of a court clerk as well as the attendance slip of the applicant.
The court observed that the contents of the application appeared to be contrived.
The court dismissed the application and issued a show-cause notice for contempt of court and ordered to frame charges against Hussain, on the hearing of the Gourmet company case on August 6.
