SC hears petitions seeking Musharraf treason trial

While hearing petitions regarding initiating treason case against former president General (r) Pervez Musharraf, Justice Jawwad S Khawaja on Wednesday said that the court will meet all the requirements of justice.

A three-judge Supreme Court (SC) bench headed by Justice Jawwad S Khawaja heard the treason petitions against Pervez Musharraf. During the course of the proceedings, Justice Khawaja remarked that all the requisites of justice would be met as the court had to follow the Constitution and law.

Pervez Musharraf’s lawyer Ibrahim Satti Advocate told the bench that he had submitted the request for the copies certified by the Supreme Court but he had not yet received the documents. He further said that his client had no access to official records.

Earlier, the interim government had refused to try former president General (retd) Pervez Musharraf for treason under Article 6 of the Constitution.

In its reply to the apex court, the interim government said that considering, deliberating or commencing any legal proceedings under Article 6 of the Constitution would be a move beyond its mandate.

The reply further said that the interim government was busy with the security of election candidates. Justice Jawaad S Khawaja remarked that the court had been seeking an answer from the interim government and after eight days it told that nothing could be done.

Justice Khawaja further remarked that the interim government said it was not in its mandate to initiate proceedings and in the future it may say that a FIR cannot be lodged.
