The Supreme Court (SC) announced its verdict on presidential reference over the appointment of judges in the light of 18th and 19th amendments, a private TV channel reported.
The court’s reply noted that the president and the prime minister have no role with respect to the appointment of judges.
It further mentions that after the passage of the 18th and 19th amendments, the president only enjoyed nominal authority on the matter, adding that the president was bound to approve the judicial commission’s recommendations.
A five-member bench comprising Justice Khilji Arif Hussain, Justice Tariq Parvez, Justice Ejaz Afzal Khan, Justice Gulzar Ahmed and Justice Sheikh Azmat Saeed had reserved its verdict on December 14, 2012.
In the order, the SC ruled that a judicial commission is responsible to appoint senior judges according to the Constitution.
President Asif Ali Zardari had sought clarity on his role in the appointment of judges through a reference, which was filed by the law ministry and sought advice on 13 points.
