The Sindh High Court (SHC) was informed on Friday that statement of applicant for registering an FIR against the former Sindh home minister Zulfiqar Mirza under the blasphemy law does not make out any cognizable offence.
The single bench comprising Justice Farooq Ali Shah was heard the application filed by MQM leader Rauf Siddiqui who sought contempt of court proceedings against the police for not complying with a court order regarding registration of FIR against Zulfiqar Mirza.
The applicant stated that on his petition a SHC bench had ordered the SHO Kalakot on December 7 to record his statement under Section 154 of the Criminal Procedure Code and lodge FIR if the statement of the applicant constituted any cognizable offence.
However, he submitted that despite passage of around three weeks, the SHO did not lodge the FIR and he was liable to be punished. Earlier the court had ordered the SHO to appear in person to explain as to why the court order dated December 7 had not been complied with. On Friday SHO Kalakot, Javed Baloch, submitted that in compliance of the court order he recorded a fresh statement of the applicant. He said he had gone through the statement received from the applicant but it does not make out any cognizable offence under the blasphemy law. Therefore, he appealed to court for disposing of the application. The court put off hearing till 10th .
