Another PCO judge files plea against contempt charges

ISLAMABAD – Justice (r) Iftikhar Hussain, a retired chief justice of the Lahore High Court (LHC), on Tuesday filed an intra-court appeal in the Supreme Court seeking setting aside of its earlier short order of initiating contempt proceedings against him from Feb 21.
Earlier on Monday, Justice Shabbar Raza Rizvi, a dysfunctional judge of the LHC had filed a similar plea. Dr Khalid Ranjha, counsel for Justice (r) Iftikhar Hussain Chaudhry prayed that the Feb 2 order was not appropriate, as it did not fulfil the legal obligations.
The appeal contends that no contempt proceedings could be initiated against his client unless there was sufficient material on the record to establish that the restraint order had actually been served on him. “Quite to the contrary, there was sufficient material on the record by way of an affidavit of the appellant that the contents of restraint order were never communicated to him through legal and authorised means prior to the time he took oath,” the appeal said.
