LAHORE – Lahore High Court Justice Sheikh Azmat Saeed on Tuesday adjourned the hearing of a petition against the removal of four additional judges by the Parliamentary Committee after the petitioner counsel sought time to argue on maintainability of the petition.
The court raised the question if the parliamentary committee’s matter could be taken up under writ jurisdiction of the court. The court prima facie was of the view that taking up an issue related to the parliament could not be called in question before the court of law in terms of Article 69 of the Constitution.
The petitioner, Noshab A Khan, claimed that his was a public interest matter and the court had the jurisdiction to take it up for hearing. On being asked by the court to argue on this point, the petitioner sought time for preparation, on which the court adjourned the hearing indefinitely.
