The Supreme Court on Wednesday resumed hearing on 27 identical petitions filed against contempt of court law, according to a private TV channel.
A five-member bench of the court comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Shakirullah Jan, Justice Khilji Arif Hussain, Justice Jawad Khawaja, and Justice Tassaduq Jilani was hearing the petitions.
Federation’s counsel Abdul Shakoor Paracha continued with his arguments.
Paracha argued that the parliament enjoyed the authority to grant immunity to anyone and could legislate on immunity, adding that parliament was entrusted with lawmaking while judiciary has the powers to interpret it.
Justice Jawad Khawaja remarked the parliament was still working under limitations as it could not interfere in the legislation done by provinces.
Justice Tassaduq Jilani said that law should reflect the essence of Constitution, adding that the judiciary respected parliament but law could not be made by simple majority.
Chief Justice Iftikhar remarked the Constitution did not say public office holders would be immune to prosecution in case they commit contempt of court.
