A petition was filed in the Sindh High Court (SHC) on Thursday seeking to prohibit Prime Minister Yousaf Raza Gilani from performing his official duties after his conviction from the Supreme Court.
The SHC approved petitioner Maulvi Iqbal Haider’s plea for urgent hearing and the matter will be proceeded today (Friday).
In his miscellaneous application, the applicant submitted that the prime minister stands disqualified after the Supreme Court decision.
“By disobeying the court order, the premier already stands disqualified from any public office under the Article 63, 1(g) of the constitution,” it was stated in the plea.
A reference was sent to the National Assembly speaker but it was not forwarded to the Election Commission.
He prayed the court to direct the National Assembly speaker and other authorities concerned to ask Gilani not to use his office until the petition is decided.
Another petition by the same petitioner seeking disqualification of Gilani is already being heard at the high court. The bench had issued notices to the federal government through the attorney general but he never appeared in the case.
