SHC orders action against defaulting private school

The Sindh High Court (SHC) ordered the Sindh Education Department on Wednesday to cancel the registration of a private school for causing a loss of one academic year to its students through negligence.
The school administration had failed to submit the annual examination forms of its students at the education board before the due date.
The SHC division bench including Justice Maqbool Baqar and Justice Shafi Siddiqui ordered the Sindh Education Secretary to cancel the registration of Madina Excellent Model School, Baldia Town for not submitting the examination forms of 63 Matriculation students as per schedule.
The bench also directed the school management to reimburse the one-year fees to the students as they could not appear in the exam due to negligence of the school’s principal.
The bench asked the board representative for any appropriate measure to save the academic year of the students but the board official said that the procedure of forms submission has completed and the examinations have started and at this stage, the board is unable to adjust the students.
Petitioner Ambar Javed and others parents of the students of Grade IX had filed a constitutional petition submitting that they tendered their examination fees to the school administration, but due to the demise of the school principal’s mother, he could not submit their examination forms before due date.
The petitioners prayed the court to direct the matriculation board management for submission of their examination forms to save academic year.
The court in its order also stated that the parents of students can file a damage suit against the school management.
