President can’t be presented before Swiss magistrate: Aitzaz

Aitzaz Ahsen, counsel for Prime Minister Yousaf Raza Gilani in the contempt case against him, on Thursday said President Asif Ali Zardari was a constitutionally elected head of state and enjoyed absolute immunity under international law, thus he could not be presented before a Swiss magistrate for trial.
Talking to reporters at the Supreme Court after adjournment of the contempt case against Gilani, Aitzaz said he was concentrating his arguments on a specific point to change the opinion of the judges about writing to the Swiss authorities for reopening graft case against President Zardari.
He said under Article 10-A, any judge, who initiated a case and framed charge against anyone in any contempt of court case‚ could not hear the very case. He said Zardari was a constitutionally elected president, thus he could not be left at the mercy of any foreign court because he enjoyed immunity under the international law. To a query, he said his arguments were simple and to the point. He said he would try to conclude his arguments by Wednesday, as asked by the court. He said the case had nothing to do with corruption, instead it was a matter related to the constitution. Whatever would be the decision of the Supreme Court in the case, it would be implemented, he added. He said the US saved Raymond Davis who took innocent lives in Pakistan, while “we are hell bent to surrender our president to a Swiss magistrate”.

  2. This is an attempt to delay things so that the case becomes time barred in Swiss Courts.

    If it is not a corruption issue, then where did Zardari get those millions that are in the Swiss bank accounts?

    • The constitution clearly states exemption for President. But u people want to prefer ur hate over Constitution: the same recipe by which Pakistan has reached its present predicament.

    • You people dont want to follow the constitution and want to quench ur thirst of hate. This is the same recipe by which Pakistan has reached its present predicament. The Constitution unequivivocally declares exemption, but courts and u people want to impose ur hate agenda on constitution.

    • The issue is about 'both and more', and keeping things in balance…

      The priority of Pakistan should be to get a solid foothold of civilian government and democracy (the price is swallowing some misdeed for the time being). Otherwise the future of Pakistan, in bigger perspectives (like economy, institutions, human rights, international relations etc.), would be compromised and some vested interest find it easy to fish in the muddy water…

  7. there is no need to arrest Zardari in this case, simple plain letter to start the process again like they sent before to stop it! He was convited in this case along with BB, the case was on appeal in switzerland when they stopped persuing it! Just write the letter, swiss are very just people they will deal it very nicely!
