SC dismisses Dogar’s plea for staying contempt proceedings

ISLAMABAD – The Supreme Court on Monday dismissed a plea by former chief justice of Pakistan, Abdul Hameed Dogar seeking staying of the contempt proceeding against him for taking oath under the Provisional Constitutional Order (PCO) in violation of SC orders of November 3, 2007.
A four-member bench comprising Justice Mahmood Akhtar Shahid Siddiqui, Justice Jawwad S Khawaja, Justice Khilji Arif Hussain and Justice Tariq Pervez was hearing contempt of court cases against superior court judges who took oath under the PCO.
In his appeal, Justice (r) Abdul Hameed Dogar had asked the court to stay the contempt of court proceeding in the matter until the final disposal of a pending intra-court appeal of 2007. Ibrahim Satti, lawyer for the former CJP, submitted that his client would file an appeal against the court’s decision and it should be heard by a larger bench as well.
The court observed that filing of an appeal was the right of his client, however, he needed to continue his arguments .The lawyer, however, contended that he would first argue the appeal of his client.
Justice Siddiqui observed that the court would try its best to fulfill legal procedure in the case and adjourned the hearing until Tuesday (today).
