Former Supreme Court Jstice (r) Khalilur Rehman Ramday on Saturday said no one could get immunity while staying at home and one had to go to the court to claim it. In an interview with a private TV channel, Ramday said the letter, which was written to the Swiss authorities had no link with criminal law, while the government of Pakistan did not give any application in this regard. He said one of the foremost obligations of the SC was to interpret the law and constitution.
There was a criminal proceeding of Aggravated Money Laundering to which Pakistan was a civil party. When Pakistan wanted to withdraw from the proceedings, as it did, how can Mr. Ramday say it had no link with criminal law. Any application by a party in a criminal case is an application under Swiss Criminal Procedure. In Switzerland there is Civil Law Sir, not Common Law and I happened to have practiced in both jurisdiction. I am simply baffled at the statement.

Its a pity that some ex-tops can not accept their retirement and behave like sitting officials, in particular Generals and Judges. Mr. Ramday is no exception. After serving his full tenure, plus one year extension as ad-hoc judge and a sencond failed extension attempt by the CJ Iftekhar Ch. (thx to Asma Jahangeer), its time now to really retire. Everyone knows that the real culprit behind the Swiss Banks’ problem was his own brother Ch. Farouq, the then Attorney General, and its quite obvious that he will go to any limits to prove his late brother right. I suggest him to refrain from feeding the sitting-bench, as the conducting H’able judges are as capable as he used to be. If at all he can’t, he should come forward and present his arguments to the bench, which will be more dignified behaviour.
