During the hearing of a petition challenging the appointment of retired judges as chief judge or judge of the Supreme Appellate Court of Gilgit-Baltistan (GB), Attorney General Maulvi Anwarul Haq submitted before the Supreme Court on Friday that it had no jurisdiction to entertain the plea.
He argued before a two-member Supreme Court bench of Chief Justice Iftikhar Muhammad Chaudhry and Justice Khilji Arif Hussain that only the Appellate Court of Gilgit-Baltistan had the jurisdiction to entertain the plea.
Muhammad Ikram Chaudhry, counsel for the petitioner, told the court that the Legislative Assembly of Gilgit- Baltistan had passed a resolution unanimously that Gilgit-Baltistan Supreme Appellate Court was not according to the constitution, thus it had demanded that it should be made per constitution of Pakistan.
