Public functionaries, institutions failed to perform duty: CJP

Chief Justice of Pakistan Justice Iftikhar Muhammad Chaudhry on Saturday said state institutions and public functionaries have failed to carry out their constitutional duties, forcing the judiciary to come into action.
Addressing a reception given by the Lahore High Court Bar Association in his honour, the chief justice said, “Energies of the judicial organ are being consumed because of the inability of the other state functionaries and public functionaries to carry out their constitutionally mandated duties. In such eventuality, the judiciary comes into action not because of choice but because of the compulsion to discharge a duty.”
He pointed out that the judiciary was often faced with situations where the executive showed stubbornness in submitting to the principles of the rule of law and acted in an arbitrary manner. Then the people took recourse to the judiciary which was required to take up the matter into its hands and resolve the issue and grant relief.

  1. This is true that no department is working or solving the problems of the peiple.
    for example PTCL has Closed the Kashmiri Bazar Murree Exchange Number 607 which was installed 16 years ago and was closed on July 29,2011 by depriving the people of the area.we contacted every authority but in vain.We Appeal the Chief Justice of Pakistan(Iftikhar Muhammad Chaudhry for SUOMOTO action in this case.
    Reference our application dated Sept,09,2011 to the CJ through Director Human Rights.

  2. The malaise is all around. High profile cases may be important but it is much more important that common man has access to justice. Unfortunately, like any other department, our judiciary is corrupt and incompetent from top to bottom. I would strongly advise the Chief Justice to work day and night to clean the judicial system. Till such time, he has no moral authority to talk about others. Judiciary must not become part of political games being played.

  3. There is corruption in Pakistan from Patwari,Police to Minister Level.Chief Justice(Honourable) is the last hope.Judiciary must clean Pakistan from Corruption from top to bottom level.

  4. Nation is re-coursing towards judiciary in every matter, as far as the competency of judiciary is concerned "They are functional" before and since their deposition. Corruption remained the part and parcel from 1960's CJP is not miracle man but man with determination and courage. Yes! malaise is all around but our journey towards prosperity has not been over yet.in majority from Patwari to other public functionaries are corrupt but this cardinal point of appointment's of judges should be kept in brains that people sitting in administrative offices are indulged with such business and are ready to stubborn with their arbitrarily mood. in a nut shell kindly try to understand the situation, Pakistan is not a welfare state and judiciary has moral, ethical and legal authority to intervene in any matter related to the nation's interest.
