The Islamabad High Court (IHC) on Monday restrained the Capital Development Authority (CDA) from making officials of Islamabad Police vacate the G/6 flats they were ‘illegally’ occupying.
A single IHC bench of Justice Riaz Ahmed Khan resumed hearing of the petition filed by police constables Yasir Qadeer Ahmed, Asmat, Gul Khan and others. He granted a stay-order in favour of the applicants again. Earlier, the petitioners had approached the court seeking allotment of the flats and managed to get a stay-order in the August 4 hearing. However, on August 17, Justice Riaz Ahmed vacated the stay order because of non-appearance of the petitioners and their lawyers.
On Monday, the petitioners contended in court that they had not been able to attend the previous hearing due to emergency duties. The petitioners asked the court to grant a stay order for their possession. They contended that if interim relief was not maintained, they would be dispossessed from their dwellings forcibly, which would cause great difficulties for them and their children. Justice Riaz Ahmed granted the stay order and adjourned the hearing for an indefinite period. More than 200 police officials of ICT Police are occupying the CDA-owned flats. The CDA built these flats 14 years ago to provide housing facilities to low-income groups, but they were not able to benefit from it.
