ISLAMABAD: The Islamabad High Court (IHC) Tuesday turned down the decision of the Election Commission of Pakistan (ECP) for disqualifying a lawmaker named in ‘fourth schedule’ under Anti-Terrorism Act.
The court decided that the ECP was not authorised to disqualify any member of National Assembly named in ‘fourth schedule’.
Justice Aamer Farooq announced a short order on a petition filed by a member provincial assembly (MPA) from Khyber Pakhtunkhwa (KP) Shah Muhammad.
On September 21, 2017, the ECP had disqualified MPA Shah Muhammad and member District Council Bannu Gulbaz Khan as their names were placed on the fourth schedule.
The MPA had moved a petition to the IHC through his counsel Dr Baber Awan challenging the decision of ECP.
