IHC suspends order for eviction of Gulshan-e-Jinnah flats

ISLAMABAD: The Islamabad High Court (IHC) on Monday suspended a single member bench’s order for eviction of government flats in Gulshan-e-Jinnah from allottees and sought reply from respondents within two weeks.

A divisional bench, comprising Chief Justice Athar Minallah and Justice Miangul Hassan Aurangzeb, conducted hearing on a petition filed by 156 residents of

Gulshan-e-Jinnah flats challenging single member bench’s decision.

The petitioners had stated in their plea that there was no time period mentioned for the flats allotments in government rules 1983. The single member bench had announced the judgment on this ground and ordered for eviction of residences from legal allottees, it further said.

Petitioners’ counsel Shah khawar Advocate pleaded that the single member bench was not rightly assisted on the issue. In 2010, the prime minister had ordered that the allotment could be cancelled only on non-payment of rent.

After hearing the arguments, the court barred the Ministry of Housing and Works from evicting the allottees from residences and sought reply from respondents within two weeks.

It may be mentioned that earlier a single member bench, comprising Justice Mohsin Akhter Kiani had ordered the ministry to vacate government accommodations from the residents, having more than six month older allotments.
