ISLAMABAD: The Supreme Court (SC) on Thursday, disposing of a case pertaining to the electrocution of a child during a marriage ceremony in Abbottabad, directed the parties to approach the relevant forum.
A three-judge bench, headed by Chief Justice of Pakistan (CJP) Asif Saeed Khosa, heard the appeal challenging the decision of the high court which had declared the trial court verdict of financial compensation to legal heirs as illegal.
“I am surprised that the trial court awarded sentence to Peshawar Electricity Supply Company (PESCO) instead of the nominated accused in the case,” the chief justice remarked, questioning how could he send a company to jail.
The top judge said that the Peshawar High Court (PHC) had also accepted the appeal against the company for hearing whereas PESCO was not even made a respondent in the case.
“How can we direct a company to pay the financial compensation when it is not even a party in the matter,” Justice Khosa said.
He then remarked it would be better for the applicants if they filed a civil case against the company for compensation and disposed of the case.
