The Pakistan Bar Council (PBC) has lodged a demand with the Supreme Court (SC) to regulate its suo motu powers under Article 184(3) of the Constitution.
In a meeting of the PBC on Saturday, the resolution was put up for consensus. It was also announced that PBA chairman, Vice Chairman Kamran Murtaza and Chairman Executive Committee Shabbir Shar, would meet Chief Justice of Pakistan (CJP) Mian Saqib Nisar to discuss the matter.
The resolution added that all 17 judges of the apex court should hear the matter “if the case is to be resolved judicially”.
“Is there any consensus or majority opinion amongst judges as to what is sought to be enforced is a fundamental right contained in Chapter-I of Part-II of the Constitution? How the matter in proceedings involves a question of public importance?” the letter put before the top court added.
The letter raised an issue with the manner the Article has been used in the last decade, as it empowers the court vis-à-vis other organs of the state and particularly the chief justice.
