SC refuses to transfer Majeed Achakzai hit-and-run case

ISLAMABAD: The Supreme Court (SC) on Friday rejected a plea by former member of provincial assembly (MPA) Abdul Majeed Khan Achakzai to transfer his case from an anti-terrorism court (ATC).

Achakzai has been accused under Section 322 of the Anti-Terrorism Act (punishment for murder) for running over and killing a traffic police sergeant, Haji Attaullah in June last year.

As a three-member bench headed by Justice Gulzar Ahmed heard the case, he said that a compromise cannot be reached if a case is tried in ATC, and Achakzai will have to go through the judicial process.

Earlier, the case was transferred from Balochistan High Court (BHC) to ATC, and the Pakhtunkhwa Milli Awami Party (PkMAP) leader was granted bail in the hit-and-run case.

Police had initially registered an FIR [First Information Report] against an unknown accused.

Achakzai was only arrested after a video of the hit-and-run was shared widely on social media, prompting authorities to take action against the legislator.

Chief Justice of Pakistan (CJP) Justice Mian Saqib Nisar had on June 28, 2017, taken a suo moto notice of the incident and sought a detailed report from the Balochistan police. After reports of the comprise with the MPA surfaced, the deceased traffic policeman’s son had denied any such agreement.
