ACD recommends FIRs against Mustafa Kamal, others in China cutting case

KARACHI: Complying with the orders of the Supreme Court of Pakistan (SC), Sindh Anti-Corruption Department (ACD) has recommended registration of a First Information Report (FIR) against Pak Sarzameen Party (PSP) leader and former city mayor Mustafa Kamal and Muttahida Qaumi Movement (MQM) leader and former deputy mayor Nasreen Jalil for their involvement in China cutting of 1459 amenity plots meant for Treatment Plant-II in Mehmoodabad area, it was learnt on Saturday.

Besides, the ACD has also recommended separate FIRs against some 26 officials of the defunct Karachi City District Government Karachi (CDGK), Revenue Department and other government bodies.

According to the documents, ACD Assistant Director Masoor Ahmed Jatoi has investigated illegal encroachment upon approximate 46 acres of land of Treatment Plant-II in Mehmoodabad area of the metropolis.

Some 136 encroachers filed Civil Suit No 362/2017 at Sindh High Court (SHC) claiming that they have been given leases by CDGK and got a stay order. The note further indicates that such illegal encroachers have encroached 46 acres of land reserved for Treatment Plant- II and having the status of amenity land”, the documents say.

“That prior to 1983, Karachi Water Management Board (KWSB) was under the umbrella of Karachi Metropolitan Corporation (KMC)/Karachi Development Authority (KDA).

“According to amended Sindh Local Government Ordinance 1979 created a Board called Karachi Water and Sewerage Board and all the installations for Water and Plants of Sewerage Treatment either established by KDA or KMC were transferred to KWSB,” the documents said.

The documents further said, “The land 49.25 acres to CDGK for utilization of the same for resettlement of affectees of Preedy Street (Line Area) which the city nazim approved.

Thereafter the CDGK processed the layout plan of the land 49.25 acres to be allotted to affectees of the Lines Area. The same was approved by MPGO and such resolution was passed by the city council Karachi.

Subsequently, plots were allotted and possession was handed over to the allottees though there were status quo orders of SHC in Suit No 342/2009. Also, the Chief Minister Sindh had passed orders “Pl/ ensure that no encroachment takes place on amenity plot and report.

Some 49.25 acres illegally handed over by the KWSB for allotment to so called shiftees planned and Layout Plan was approved mentioning 5 blocks (ABCDE) having created plots of R type measuring 120 sq yard 661, L type measuring 80 sq yard, 608 and LS type commercial measuring 20 sq yard 190 total no of plots 1459.

The record of allotment has not been provided by KMC as well as LARP. However, allotment of plot no L-144 sector D has been collected through sources. The record indicates that survey slip and demolition certificate from LARP has been issued in March 2009 and allotment has also been issued in March 2009 in the name of Kashif Ahmed Khan son of Saghir Ahmed Khan holder of CNIC 42401-1437681-7 while in the list of shiftees the allotment of plot in question has been shown in the name of Muhammad Younus son of Muhammad Yousaf.

Furthermore, a piece of land 33.27 acres was also got illegally encroached and officers of CDGK (Land) Mohsin Ansari, Alley Ahmed Naqvi and Nadeem Khan in connivance of Jamshed Town-I Sub-Registrar and others executed leases without any authority and approval as well as approved layout plan.

In such leases, a number of plots have been mentioned without any block simply measuring 80 sq yards and without mentioning any category/type.

The cost of involved land is approximate Rs3 billion compared to market value. Thus they with common intention and ulterior motive committed criminal breach of trust and fraud/cheating and prepared false-forged documents an offense punishable U/S 409, 420, 468, 471 PPC R/O Sec 5 (2) Act-II of 1947.
