- IHC directs govt to form a commission to develop a sustainable environmental management plan
ISLAMABAD: Islamabad High Court (IHC) on Tuesday declared constructions in Bani Gala and Sector E-11 as illegal and ordered to demolish these buildings that are violating the master plan of the federal government.
A three-member bench headed by Justice Athar Minallah announced the decision consisting of 72 pages. The court said that to favour the privileged community, the master plan was violated as it maintained individual’s authority instead of law and order implementation.
The decision reads that delay in providing justice was injustice itself. It is pertinent to mention here that Shehzada Sikanderal-Mulk and other citizens had challenged the constructions of Bani Gala and E-11 in the court.
The Islamabad High Court also warned that failure to develop a sustainable environmental management plan can worsen the water and environmental crisis in the federal capital and directed the government for form a commission over the issue.
“It is an undeniable fact that unregulated human activities such as illegal construction, urbanisation and violation of the Master Plan [of the Islamabad Capital Territory (ICT)] have serious consequences which inevitably leads to irreversible environmental degradation and climatic changes,” the bench observed.
“We direct the federal government to forthwith take steps of constituting a commission, inter alia, of professional experts, preferably of international repute, in the field of town planning, environmental management and finance.”
