IHC irked over delay in removal of encroachments in capital

ISLAMABAD: Islamabad High Court (IHC) expressed discontent on Thursday over the non-implementation of its order to remove the encroachments from the capital, asking whether there’s a separate law for those holding guns.

A single bench of IHC presided over by Justice Shaukat Aziz Siddiqui heard a miscellaneous petition filed by Ministry of Defence on the matter of removal of encroachments from the city.

While hearing of the case, Barrister Khurram Hashmi appeared on behalf of secretary defence.

The counsel for the petitioner argued June 22 decision will inflict irreparable loss on his client as well as people.

The learned judged remarked, “Is there a separate law for gun holders. Anyone can occupy any land in the name of security concerns. If there are security threats then Marriot Hotel should occupy more land. Judges and lawyers were targeted in F-8 kutchery.”

The counsel for the petitioner prayed court should review its decision taking into account the facts.

It may be mentioned that court on June 22, 2018 had ordered for removing all encroachments from the city and opening all avenues.

The court had also directed CDA to open the road passing in front of the office of the intelligence agency in Aabpara.

The defence ministry took the plea that ISI is the largest agency of the country. Therefore it is facing more security threats than others.

Registrar IHC had returned the petition with raising objections before the announcement of detailed judgment.

The ministry of defence filed a miscellaneous petition when the court resumed the hearing of illegal bus terminal case.

The court adjourned the hearing of the case till June 29 after hearing arguments.
