Establishment Division preparing new deputation policy

ISLAMABAD: The Establishment Division (ED) has decided not to absorb any non-cadre officers, including teachers and doctors in any cadre posts of occupational groups and services in future.

Sources told this scribe that the department, on the instructions of the Supreme Court (SC), is preparing a new deputation policy and the policy would be approved by the next government because the caretaker government has not any authority to make or approve the policy.

Officers said that the department is preparing the policy in line with the instructions of the top court.

The proposed deputation policy include that posting on deputation shall not confer upon any right for permanent absorption through the method of appointment by transfer.

The permanent absorption of non-cadre officers in OMG had been a major issue in the recent years when ED had tried to absorb more than 90 officers in OMG. Subsequently, the OMG officers had taken relief from the apex court.

Now they are demanding the ED secretary to repatriate these officers but the high-ups of ED are not paying any heed to this matter.

The proposed policy further include that secretaries of the administrative ministries/divisions shall be responsible for adhering to the principles and spirit of the judgement of the SC passed in CRL 89 of 2011 while processing the cases of deputation for posts belonging to the cadres/posts under their administrative control and also in respect of posts in the departments under their administrative control.

In addition to this, secretaries of the administrative ministries/divisions shall be competent to approve the initial deputation of officers up to BPS-19 belonging to the cadres and posts under their administrative control and also in respect of posts in the departments under their administrative control for an initial period of three years by invariably endorsing the copy of such orders to ED.

The cases of extension in the period of deputation beyond three years shall be referred to the ED at least 60 days in advance before the completion of the said period clearly indicating the justification for extension and reasons for not filling up the post on regular basis in accordance with the recruitment rules of the post, the proposed policy indicated.

The maximum period of deputation of government servants belonging to provincial governments, the government of Gilgit Baltistan (GB) and Azad Jammu and Kashmir (AJK) or any other authority to the federal government shall be five years.

In case the ministries/divisions/departments intend to absorb the deputationist through appointment by transfer, they may reserve a specific quota for that purpose in the recruitment rules of the post concerned in consultation with ED under sub-rule (2) of rule 3 of the Civil Servants (Appointment, Promotion & Transfer) Rules, 1973 and posts in BPS-16 and above by transfer shall be filled through FPSC.

Finally, the civil servants who are appointed through an initial appointment and are on probation shall not be sent on deputation until and unless their probation has been satisfactorily completed.

The posting of a government servant on completion of maximum period of five years shall not be converted into posting as such or against any other post under Section 10 of the Civil Servants Act, 1973 and no officer should be sent on deputation unless he has completed three years’ service in his parent department after return from an earlier deputation. In case the government servant is repatriated on account of misconduct/discipline, he shall not be sent on deputation unless he has earned good or above report for three years.

It is pertinent to mention here that presently more than 200 offices are on deputation, the officer of ED told that these officers will return back to their parent department once the three years tenure will be completed.
